This article summarizes the Supreme Court’s decision in LaRue as well as the major cases that led up to the decision. The article also analyzes the legal implications of the Court’s decision and describes strategies for plan sponsors and fiduciaries to minimize the risk of lawsuits under section 502(a)(2) of ERISA.
